Terms of Use

1. Service owner

VOLANDOO SOLUTIONS SLU, Tax ID B44544914, with registered office at CALLE VERGE DEL PILAR, NUM 15, 46210 PICANYA - (VALENCIA), Spain, operates Orbitali. You can contact us at info@volandoo.com or info@orbitali.ai.

2. Acceptance

By creating an account, accessing the dashboard, using the API, configuring agents, connecting owned numbers, making payments, or using any Orbitali feature, you accept these terms. If you act on behalf of a company, you confirm that you have authority to bind it.

3. Description of Orbitali

Orbitali provides infrastructure to deploy AI voice agents on real phone numbers that the customer manages with compatible providers such as Telnyx or Twilio. The platform may include account and organization management, API keys, owned-number configuration, agent configuration, prompts, tools, webhooks, knowledge base, call history, transcripts, usage, and billing.

Orbitali does not replace your backend, your internal processes, or your legal obligations to end users, customers, employees, or callers.

4. Accounts, security, and API keys

• You must provide accurate information and keep account, organization, and billing data up to date.
• You are responsible for protecting credentials, sessions, API keys, secrets, headers, and server URLs.
• You must notify us without delay if you detect unauthorized use or a security incident related to Orbitali.
• We may suspend or limit accounts, keys, or resources if we detect abuse, security risk, non-payment, or breach of these terms.

5. Your agents, calls, and data

• You are responsible for the prompts, instructions, greetings, tools, schemas, URLs, webhook responses, uploaded documents, and business logic you configure.
• You must have a valid legal basis, notices, and consents required to record, transcribe, analyze, or process calls, voice, metadata, and conversational content.
• You must inform callers when they interact with AI or when a conversation may be processed by technical providers.
• You must not enter into Orbitali data you have no right to process, nor especially sensitive data unless you have sufficient authorization and adequate measures.
• You are responsible for reviewing, testing, and monitoring your agents before using them in production.

6. Acceptable use

You may not use Orbitali for illegal, abusive, deceptive, or harmful activities.

• Fraud, phishing, impersonation, spam, harassment, threats, or unsolicited calls contrary to law.
• Capturing or processing data without a legal basis, required consent, or adequate information.
• Emergency services, high-risk decisions, or uses where an error could cause material, physical, legal, or financial harm without adequate human oversight.
• Attempts to bypass limits, access others' accounts, exploit vulnerabilities, interfere with infrastructure, or resell the service without authorization.
• Content or instructions that infringe third-party rights, confidentiality, intellectual property, or applicable regulations.

7. Phone numbers and providers

Orbitali does not provide or manage phone numbers. You must supply and maintain your own numbers, credentials, permissions, configuration, availability, and compliance with compatible providers such as Telnyx or Twilio.

We may suspend or limit the connection of numbers or integrations when necessary for technical, legal, regulatory, security, non-payment, or misuse reasons. Your telephony provider may apply its own terms, costs, limits, and anti-abuse policies.

8. AI, accuracy, and oversight

Orbitali uses AI models and providers that may produce errors, omissions, delays, inaccurate transcripts, unwanted responses, or non-deterministic results. We do not guarantee that agents are correct, complete, or suitable for every case.

You must design appropriate limits, instructions, testing, human fallback, and oversight for your use case, especially in customer communications or critical business processes.

9. Payments, credits, and billing

Prices, credits, limits, taxes, and payment terms will be shown on the platform or in the current commercial documentation. Payments may be processed via Stripe or other providers.

Unless otherwise stated, amounts paid for credits or consumed usage are non-refundable. We may suspend the service for non-payment, fraud, chargebacks, or use that exceeds contracted limits.

10. Intellectual property

Volandoo Solutions SLU retains all rights to Orbitali, its software, documentation, brand, design, APIs, infrastructure, and technology. You are granted no rights other than the limited use needed to access the service under these terms.

You retain the rights to your data, documents, prompts, and configurations. You grant us a limited license to host, process, transmit, and use them solely to the extent necessary to provide, protect, and improve Orbitali.

11. Availability and changes

We may modify, improve, limit, or discontinue Orbitali features. We will try to avoid unnecessary interruptions, but we do not guarantee continuous availability, freedom from errors, or permanent compatibility with external integrations.

12. Termination

You can stop using Orbitali at any time. We may suspend or cancel your access if you breach these terms, create risk for the platform or third parties, fail to pay amounts due, or if the law or critical providers require it.

13. Liability

To the maximum extent permitted by law, Orbitali is provided without warranties of specific results. We will not be liable for indirect losses, lost profits, data loss, business interruptions, or claims arising from your agents, your webhooks, your instructions, or your use of calls and data.

Our total liability for any claim related to Orbitali is limited to the amount you paid for the service in the three months prior to the event giving rise to the claim, unless applicable law does not allow such a limitation.

14. Governing law

These terms are governed by Spanish law. Unless consumer or user regulations provide otherwise, the parties submit to the courts and tribunals of Valencia, Spain.
